IAS

IAS is the Acronym for Internet Access Service

A core statutory branch of an Electronic Communications Service (ECS) defined under Article 2(5) of the European Electronic Communications Code (EECC) (Directive (EU) 2018/1972) and governed by the EU Open Internet Regulation (Regulation (EU) 2015/2120).

It refers to a publicly available electronic communications service that provides internet connectivity, enabling end-users to send and receive data across virtually all endpoints of the global web, regardless of the underlying network technology or terminal equipment used.

Technical Scope: What Qualifies as an IAS?

An IAS acts as a neutral pipe, providing open-web transport. Services within this classification include:

  • Fixed Broadband & Fiber: Residential and enterprise FTTH (Fiber to the Home), cable, and DSL connections.
  • Mobile Data Connectivity: Cellular internet connections over 4G, 5G, and 6G networks provided by Mobile Network Operators (MNOs) and MVNOs.
  • Satellite & Fixed Wireless: Low Earth Orbit (LEO) satellite broadband (e.g., Starlink) and Fixed Wireless Access (FWA).
  • Public Wi-Fi Networks: Commercial or municipal Wi-Fi hotspots offering general internet access.

Crucial Distinction — Sub-Internet & Specialized Services: Services that artificially restrict access to specific parts of the web (e.g., a plan that only allows access to social media) are classified as “sub-internet services” and are strictly prohibited under EU law. Conversely, dedicated, quality-optimized networks—such as VoLTE, IPTV, or surgical tele-rehabilitation—are classified as Specialized Services and sit outside the standard IAS framework.

The EU Open Internet (Net Neutrality) Mandate

Because an IAS provides public access to the open web, providers of internet access services (ISPs) are subject to strict Net Neutrality rules enforced by national regulators and overseen by BEREC (Body of European Regulators for Electronic Communications):

  1. Equal Traffic Treatment: ISPs must treat all data traffic equally when providing an IAS, regardless of the content, application, or origin.
  2. Prohibition of Blocking & Throttling: ISPs cannot block, slow down, or degrade specific applications, websites, or protocols (e.g., by throttling peer-to-peer file-sharing or competitor VoIP apps).
  3. Banning Commercial Discrimination (Zero-Rating): EU courts and BEREC guidelines prohibit commercial practices such as selective zero-rating, in which an ISP excludes specific preferred applications (e.g., Spotify or Netflix) from a user’s data cap while throttling or charging for others.

Universal Service & Consumer Protections Under the EECC

Under the EECC framework, an IAS is treated as an essential utility alongside voice communications:

  • Adequate Affordable Broadband: Member states are legally required to ensure that all citizens have access to an affordable IAS capable of supporting basic digital participation (e.g., e-Government, online banking, video calls).
  • Standardized Contract Summaries: IAS contracts must present clear speed parameters (minimum, normally available, and maximum speeds) and data allowances before checkout.
  • Switching Rights & Compensation: Users have a right to switch IAS providers seamlessly, with number porting and internet reconnection required within minimal timeframes.
