EECC

EECC is the Acronym for European Electronic Communications Code

Enacted under Directive (EU) 2018/1972, it’s the overarching EU legislative directive that modernized, consolidated, and overhauled European telecommunications law.

By replacing four legacy 2002 telecom directives with a unified legal framework, the EECC expanded the traditional scope of telecommunications regulation beyond legacy telephone carriers to encompass modern web-based communication tools, direct-to-consumer messaging apps, and cloud communications platforms.

1. Expanding the Definition of Electronic Communications Services

Prior to the EECC, European telecom laws applied almost exclusively to traditional landline operators, mobile carriers, and internet service providers (ISPs). The EECC broadened the statutory definition of an Electronic Communications Service (ECS) into three distinct categories:

  1. Internet Access Services (IAS): Standard broadband and mobile data connectivity.
  2. Interpersonal Communications Services (ICS): Interactive communication tools divided into:
    • Number-Based Interpersonal Communications Services (NB-ICS): Services utilizing public phone numbering plans (e.g., cellular voice, SMS, PSTN dial-out VoIP).
    • Number-Independent Interpersonal Communications Services (NIICS): App-to-app communication tools operating purely over IP networks without using phone numbers (e.g., WhatsApp, Teams, Signal, web-based email).
  3. Signal Transmission Services: Machine-to-Machine (M2M) communications, Internet of Things (IoT) connectivity, and broadcasting transmission.

Significance: By classifying OTT messaging and video apps as NIICS, the EECC laid the regulatory foundation later used by the Digital Markets Act (DMA) to mandate messaging app interoperability for Gatekeepers.

2. Core Consumer Protection & Transparency Mandates

The EECC introduced strict consumer and enterprise buyer protections that directly govern how telecom and communications platforms onboard and retain customers:

  • Mandatory Contract Summaries: Service providers must supply a standardized, concise summary document (outlining pricing, contract duration, service speeds, and renewal terms) before a customer signs a contract.
  • Bundle Rules: When a provider bundles communications services with devices or hardware (e.g., a CPaaS subscription bundled with IP phones), consumer protection rules apply to the entire package, preventing providers from locking users into extended contracts via hardware add-ons.
  • Simplified Provider Switching: End-users are granted the right to port phone numbers between providers within one business day, with entitlement to compensation if porting processes are delayed.
  • Annual Price & Best Tariff Notifications: Providers are required to notify existing contract customers annually about the most advantageous tariffs available to them.

3. Public Safety & Emergency Infrastructure

The code modernizes EU public safety obligations to adapt to mobile-first environments:

  • EU-Alert Public Warning System: Member states are required to implement cell-broadcast or location-based SMS warning systems to send real-time disaster and emergency alerts to all mobile phones within specific geographic areas.
  • Enhanced Emergency Number Access (112): NB-ICS providers must ensure free routing to 112 emergency services while automatically transmitting accurate caller location data to emergency dispatch centres.
